Protect your invention: patent filing

Fidealis, a solution for the protection of inventions

A patent is an industrial property title allowing its holder to prohibit third parties from exploiting their invention for a maximum period of 20 years in a given territory.

In this article, we will discuss why a patent should be filed and the steps involved. We will also propose an alternative.

Why apply for a patent?

Filing a patent confers on the holder exclusive and enforceable rights on the use of their patent. It is a monopoly on exploitation.

The monopoly on exploitation makes it possible to:

  • Decide in which way to exploit the invention: directly by the owner or, by assigning or licencing the rights.
  • Oppose any exploitation of the invention without consent.
  • Prosecute any infringer of the invention.

Before applying for a patent, however, it is necessary to ensure that it meets 3 criteria: novelty, inventiveness and industrial applicability.

How do you file a patent?

In France, patent applications are filed with a specialized office. Once the filing application has been published, the administrative and technical examination procedure begins. The Office will send you its research report and opinion on the patentability of the invention. If this result is positive, the patent is published in the BOPI (Official Bulletin of Intellectual Property).

However, this procedure is long, 2 to 3 years, and expensive. It takes a minimum of 3000€ to file a patent in France. This cost includes the filing application as well as the costs of maintaining the patent during the 20-year limit, the research report, granting the patent and above all the fees of the consulting firm, essential for drafting a patent.

We, therefore, propose an alternative solution.

What alternative is there to filing a patent?

As shown, filing a patent takes time but above all is very expensive. Not all companies can afford to wait 3 years and spend 3000€ to protect their invention. But there is an alternative, copyright registration.

By registering your invention with Fidealis, real-time official registration gives it immediate protection. We carry out a prior art search which allows us to characterize the novelty of your invention. Finally, digital timestamping certifies the date of your registration protecting you in the event of an infringement of your rights.
